PT. WKS Suspected of Ignoring Regent's Letter Regarding Land Dispute Resolution
KABARTUNGKAL.COM. Sengketa lahan antara H. Soma Wijaya dengan pihak perusahaan PT. Wira Karya Sakti (PT. WKS) yang berlokasi di Betara 8 blok Ahok no 22 Kecamatan Betara, Kabupaten Tanjung Jabung Barat, Jambi terus bergulir.
KABARTUNGKAL.COM. Land dispute between H. Soma Wijaya and the company PT. Wira Karya Sakti (PT. WKS) which is located in Betara 8 Ahok block no 22, Betara District, West Tanjung Jabung Regency, Jambi continues to roll.
Pasalnya, meski sudah dilakukan mediasi 3 kali di Kantor DPRD Tanjab Barat, 1 kali di Ruang Rapat Wakil Bupati yang di pimpin langsung Wabup Hairan, SH, dan 3 kali di Kesbangpol Tanjab Barat serta sudah pula dilakukan pengecekan oleh Tim Terpadu ke lokasi lahan, namun permasalahan ini masih terkatung-katung karena tidak mendapat respon dari pihak perusahaan PT. WKS yang terkesan merasa “kuat dan kebal hukum” (?)
The reason is, although mediation has been carried out 3 times at the West Tanjab DPRD Office, 1 time in the Meeting Room of the Deputy Regent which is directly chaired by the Deputy Regent Hairan, SH, and 3 times at the West Tanjab Kesbangpol and checks have also been carried out by the Integrated Team to the location of the land, but this problem is still adrift because it did not get a response from the company PT. WKS who seem to feel "strong and above the law" (?)
Sementara sesuai hasil kajian Tim Penanganan Konflik Sosial (Timdu) melalui surat Bupati no : 300/2685/Kesbangpol/2021, tanggal 20 Desember 2021, telah menyimpulkan agar PT. Wira Karya Sakti (PT. WKS) dapat mengakomodir tuntutan H. Soma Wijaya tersebut. Namun ironisnya, hingga berita ini dipublish, pihak perusahaan PT. Wira Karya Sakti (PT. WKS) seakan mengabaikan dan tidak menggubris surat Kesimpulan yang ditanda-tangani oleh Bupati Drs. H. Anwar Sadat, M. Ag tersebut.
Meanwhile, according to the results of the study by the Social Conflict Management Team (Timdu) through the Regent's letter no: 300/2685/Kesbangpol/2021, dated December 20, 2021, it has been concluded that PT. Wira Karya Sakti (PT. WKS) can accommodate H. Soma Wijaya's demands. But ironically, until this news was published, the company PT. Wira Karya Sakti (PT. WKS) seemed to ignore and ignore the Conclusion letter signed by the Regent Drs. H. Anwar Sadat, M. Ag.
“Selaku perusahaan yang beroperasi di wilayah kekuasaan Bupati KH. Drs. Anwar Sadat, M.ag, pihak PT. Wira Karya Sakti (PT. WKS) seharusnya mengkaji dan merespon surat Bupati tersebut. Walaupun kami selaku pendamping tidak mengirimkan surat lanjutan akan tetapi surat tersebut juga telah ditembuskan ke pihak perusahaan PT. Wira Karya Sakti. Jadi, jika memang perusahaan menghargai Bupati, seharusnya mereka mengambil sikap dan mengabulkan apa yang menjadi tuntutan H. Soma Wijaya, apalagi pihak perusahaan PT. Wira Karya Sakti selaku pemegang ijin HGU berkewajiban untuk mensejahterakan masyarakat yang ada disekitar lingkungan perusahaannya.
Namun sangat disayangkan, bahkan surat Bupati selaku pemimpin daerah terkesan diremehkan dan tidak berlaku bagi pihak perusahaan PT. Wira Karya Sakti.” jelas Chaidir Is Panjaitan (Tulang) Selaku Jubir pendamping H. Soma Wijaya

Selanjutnya pihak pendamping H. Soma Wijaya yang di nahkodai Hermansyah selaku ketua LSM KMPK akan segera menemui bupati Kabupaten Tanjung Jabung Barat dengan tujuan mempertanyakan terkait perihal surat Bupati mengenai Hasil Kajian Tuntutan H. Soma Wijaya yang di duga sama sekali tidak di gubris oleh pihak perusahaan (PT WKS).

“Kita meyakini tidak ada kekuatan swasta melebihi kekuatan pemeintah. Apalagi kita ketahui bersama, bahwa Visi dan Misi Bupati dan Wakil Bupati kita, Nomor 10 berbunyi “Meningkatkan kinerja birokrasi, membentuk lembaga pengaduan masyarakat dalam rangka percepatan penyelesaian konflik lahan di Kabupaten Tanjung Jabung Barat.

Soma Wijaya sekeluarga mengalami kemiskinan karena tidak dapat memproduktifkan lahannya untuk menopang kehidupan keluarga.” Jelas Haidir

“Terkait permasalahan diatas, pemerintah seharusnya hadir untuk melindungi dan membela hak-hak rakyatnya. Berhubung alasan penggusuran lahan dan beberapa bangunan milik keluarga H. Soma Wijaya karena berada dilokasi Kawasan Hutan.” Komentarnya

Untuk di ketahui, sesuai Surat Keputusan Menteri Kehutanan RI Nomor : 744/Kpts-II/1996 tentang Pemberian Hak Pengusahaan Hutan Tanaman industri Atas Areal 78, 240 hektar di Daerah Propinsi Jambi, kepada PT. Wira Karya Sakti. Dan Keputusan tersebuat tertuang dalam Bab Empat, ayat (1) dan (2) antara lain :
For information, according to the Decree of the Minister of Forestry of the Republic of Indonesia Number: 744/Kpts-II/1996 concerning the Granting of Concession Rights for Industrial Plantation Forests over an area of 78, 240 hectares in Jambi Province, to PT. Wira Karya Sakti. And the decision is contained in Chapter Four, paragraphs (1) and (2), among others:
- Apabila didalam areal Hal Pengusahaan Hutan Tanaman Industri (HPHTI) terdapat lahan yang menjadi tanah milik, perkampungan, tegalan, persawahan atau telah di duduki dan di garap oleh pihak ketiga, maka lahan tersebut tidak termasuk dan dikeluarkan dari areal Kerja Hal Pengusahaan Hutan Tanaman Industri (HPHTI)
- Apabila lahan tersebut ayat (1) dikehendaki untuk dijadikan Hak Pengusahaan Hutan Tanaman Industri (HPHTI), maka penyelesaiannya dilakukan oleh PT. WKS dengan pihak-pihak yang bersangkutan sesuai dengan ketentuan perundang-undangan yang berlaku.
Demi tegaknya keadilan bagi H. Soma Wijaya sekeluarga yang selama puluhan tahun ditengarai telah di zholimi oleh perusahaan PT. WKS, serta sesuai amanah UUD 45 BAB 10 pasal 27 ayat (1) dan (2), dan Surat Keputusan Menteri Kehutanan RI Nomor: 744/Kpts II/1996, diminta kepada Pemerintah Kabupaten Tanjung Jabung Barat melalui Timdu Penangan Konflik Sosial Kabupaten Tanjung Jabung Barat, agar memerintahkan kepada pihak perusahaan PT. WKS untuk segera merealisasikan ganti rugi tanaman tumbuh atas lahan H. Soma Wijaya sekeluarga sesuai ketentuan dan perundang-undangan yang berlaku.(Fz & Tim)

WKS with the parties concerned in accordance with the provisions of the legislation in force. For the sake of upholding justice for H. Soma Wijaya and his family who for decades have been accused of being wronged by the company PT. WKS, as well as according to the mandate of the 1945 Constitution CHAPTER 10 article 27 paragraphs (1) and (2), and the Decree of the Minister of Forestry of the Republic of Indonesia Number: 744/Kpts II/1996, were requested to the Tanjung Jabung Barat Regency Government through the Tanjung Jabung Regency Social Conflict Handling Team West, in order to instruct the company PT. WKS to immediately realize the compensation for plants growing on the land of H. Soma Wijaya and his family according to the provisions and applicable laws. (Fz & Team)
